New Criminal Cartel Laws Commenced 24 July 2009

On 24 July 2009, Australia's new criminal cartel laws came into effect.

These laws apply to all businesses regardless of size and target conduct that is at the heart of day to day business operations. An individual who engages in cartel conduct may face up to a maximum of 10 years in jail. Companies engaging in cartel conduct also face severe penalties.

The new laws catch agreements or arrangements made before 24 July 2009 but which are given effect to after that date.

In accordance with the commencement of the new laws, the ACCC has revised its Immunity Policy, released guidelines on its approach to cartel investigations and signed a Memorandum of Understanding with the Commonwealth Director of Public Prosecutions.
